Terms of Service
These terms govern use of this website and set out the framework within which Scafell Tech Private Limited provides its services.
1. Who these terms are between
This website is operated by Scafell Tech Private Limited, a private company limited by shares registered in India, with its registered office at A 406, Om Decora 9 Square, Nana Mava Road, Mota Mava, Rajkot 360005, Gujarat, India and Corporate Identity Number U58200GJ2026PTC177943.
In these terms, “we”, “us” and “our” mean Scafell Tech Private Limited. “You” means the person or organisation using this website.
2. Scope and acceptance
By using this website you accept these terms. If you do not accept them, do not use the website.
These terms cover the website only. They are not the contract under which we supply services. Software development, integration, hosting, support and managed messaging services are supplied to client organisations under a separate written agreement signed by both parties, which sets out scope, fees, service levels, warranties, confidentiality, data protection obligations and termination. Where that agreement conflicts with these terms in relation to the services, that agreement prevails.
3. Use of this website
This website is provided for information about the company and its services. It is publicly accessible; there is no account, no login and no contact form.
You may read, print and share its content for your own information or for the purposes of an evaluation, procurement or regulatory review. You may not:
- use the website in a way that breaks any applicable law;
- attempt to gain unauthorised access to the website, its hosting infrastructure or any system connected to it;
- interfere with the availability of the website, including by automated request volumes that degrade it for others;
- copy content from the website and present it as your own, or use it to imply an association with us that does not exist.
4. Intellectual property
The content of this website, its text, layout, styling and graphics, is owned by Scafell Tech Private Limited or used with permission, and is protected by copyright and other applicable rights. The name “Scafell Tech” and the company’s mark are ours.
Software we develop for a client organisation is licensed or assigned as that client’s agreement provides. Nothing on this website grants any licence to our software, to its underlying components, or to any of our trademarks.
5. Third-party platforms and trademarks
Our services are built on the WhatsApp Business Platform, which is operated by Meta Platforms, Inc. and its affiliates. Use of that platform — by us, by client organisations and by the people who message them — is additionally subject to the terms and policies Meta publishes for it, including the WhatsApp Business Messaging Policy and the applicable WhatsApp Business terms. We do not control those terms and they may change.
WhatsApp, Meta and related names and logos are trademarks of Meta Platforms, Inc. They are used on this website descriptively, to identify the platform our software integrates with. Their use does not imply that Scafell Tech Private Limited is a partner of, is endorsed by, is certified by, or is otherwise affiliated with Meta Platforms, Inc. Any equivalent references to other companies, standards or products on this website are likewise descriptive only.
6. Services to client organisations
We provide messaging-first operational systems built on the WhatsApp Business Platform: complaint and service-request intake, multilingual conversational workflows, classification and routing, operations dashboards, and ward and zone mapping.
As part of that we act as a technology provider: we integrate the WhatsApp Business Platform on the client organisation’s behalf, and we manage its messaging infrastructure and message templates. The client organisation holds its own WhatsApp Business Account and remains the controlling party for the data collected through it.
Accordingly, the client organisation is responsible for:
- the lawfulness of the messages it sends and of the purposes it collects data for;
- obtaining and maintaining opt-in where messages are business-initiated;
- the accuracy of the content and templates it approves for use;
- the decisions its officers take on the complaints and requests it receives;
- meeting its own obligations as Data Fiduciary under applicable data protection law.
We are responsible for building and operating the system in accordance with the signed agreement, and for processing personal data only on that organisation’s documented instructions.
7. Acceptable use of the messaging services
Where we operate messaging on a client organisation’s behalf, that organisation agrees not to use the service to:
- send unsolicited marketing, bulk messages or any message to a person who has not opted in where opt-in is required;
- send content prohibited by the WhatsApp Business Messaging Policy or by applicable law;
- impersonate another organisation or misrepresent the identity of the sender;
- collect personal data through the channel for a purpose it has not disclosed to the people concerned;
- use the service in a way that would place the WhatsApp Business Account, the business phone number or our platform at risk of restriction.
We may suspend messaging on an account where continuing would breach these requirements, a platform policy, or the law — giving notice to the client organisation as its agreement requires, and restoring service once the issue is resolved.
8. People who message a client organisation
If you have sent a complaint or service request over WhatsApp to an organisation that uses our software, your relationship is with that organisation. It decides how your request is handled, what is done about it and when it is closed. We operate the messaging and case-management system on its behalf.

9. Data protection
How we handle personal data is set out in our Privacy Policy, which forms part of these terms. In relation to data processed for a client organisation, we act as its data processor under India’s Digital Personal Data Protection Act, 2023, on the basis of the data protection terms in that organisation’s agreement with us.
10. Availability and accuracy
We take care to keep the information on this website accurate and current, but it is provided for general information and may be updated at any time. It is not a specification, a quotation, an offer capable of acceptance, or professional advice.
We do not guarantee that this website will be available without interruption or free of error. Service levels for the services we supply, where any apply, are those stated in the client organisation’s signed agreement — not on this website.
11. Liability
To the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, goodwill or anticipated savings, arising from use of this website.
Our liability in connection with the services we supply is governed by the signed agreement with the client organisation concerned, including any limits and exclusions it contains. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud.
12. Links to other websites
This website links to a small number of external pages, such as WhatsApp’s published policies, for reference. We do not control those sites and are not responsible for their content, availability or privacy practices.
13. Changes to these terms
We may update these terms as our services or the law change. The revised terms take effect when published on this page, and the date at the top shows when they were last changed. Changes to the terms of a signed agreement with a client organisation are made only as that agreement provides.
14. Governing law and jurisdiction
These terms and any dispute arising out of them or out of use of this website are governed by the laws of India. The courts at Rajkot, India, have exclusive jurisdiction, save that either party may seek interim relief in any court of competent jurisdiction.
